This website is operated by SB Asset Management Ltd.  ("The Company")

This agreement outlines the terms under which the use of the SwissBullion.eu website may used, including the terms for placing orders. In order to use this website, it your responsibility to ensure that you have read and accepted our terms and conditions. These terms are subject to change without notice, however any changes will be updated on this page. 

1. Website Use

1.1 This website, or any of the products or services offered on it, are subject to change or suspension at any time by The Company. Any changes directly affecting client vault holdings will be subject to a 90 day notice period, applying only to existing clients. Terms & Conditions may be notified directly on the website, and it is up to the client to review these regularly. 

1.2 It is the user's responsibility to ensure that all services that are necessary for the use of this website (such as telephones, modems, internet connection etc) are maintained. This is not the responsibility of The Company. It is also the user's responsibility to ensure that The Company has, at all times, and up-to-date contact email address, telephone number and mailing address. 

2. Opening an Account

2.1 You must open an account in order to place orders for delivery or for vault storage. In order to do this you must: 

  1. Be at least 18 years of age.
  2. Fill out the designated registration page located here.
  3. Provide information as requested in accordance with anti money laundering and KYC (Know Your Client) regulations.


The requested Anti Money Laundering documentation includes a copy of a government issued ID and a utility bill for each beneficial owner. For accounts trading in excess of 15,000 CHF per calendar year, this document must be submitted notorized, in hard copy. The Company reserves the right to request additional information where it deems necessary. 

2.2 It is imperative that you provide all information correctly. In the event that there are any changes to your information, including your contact information, please update your profile or contact a member of customer service to assist you. It is your responsibility if accurate information is not provided, and any losses associated as a result of inaccurate information are the sole responsibility of the buyer. 

3. Payment and Prices

3.1 Live precious metals prices are provided by a leading market data provider. All prices on the website update constantly, and are therefore subject to change. The price that you are obligated to pay for your order is the price that appears on your invoice at the time the order is placed. This invoice constitutes a contract, and you are obligated to complete the purchase once the order has been placed. In the event that there is an error in pricing, due to incorrect pricing or malfunction of the price feed, The Company reserves the right to offer the buyer a requote or a cancellation. Payments for all order must be issued within two business days. Any orders that have not been paid for during this period are subject to either cancellation, re-quote, or reimbursement at the discretion of The Company. 

3.2 No order will be dispatched or allocated to client accounts unless The Company is in full receipt of a cleared payment against the order. 

4. The Process

4.1 Orders are only accepted via the website, SwissBullion.eu - Orders may not be placed via telephone. 

4.2 All details provided by the user must be accurate. 

4.3 All orders will be confirmed by email within a few minutes of being placed.

4.4  The Company does not hedge foreign exchange rates for it's clients and is not responsible for currency fluctuations. If an order has been cancelled, the refund value is based on the Swiss Franc rate in which the order was initially placed.

4.5 SwissBullion.eu reserves the right to cancel any order. 

4.6 All orders are subject to verification, payment and stock / market availability.

4.7 In the event that an item purchased is unavailable, the Buyer will have the following options:

(i) Wait until the products are available from stock.
(ii) Request different items of the same value (at time of order)
(iii) Order cancellation without penalty.

5. Delivery

5.1 Orders can only be delivered to the address that is placed on your order invoice at the time of purchase, and no deliveries can be made to PO Boxes. In order to mitigate risk of theft or loss, no orders will be dispatched on the day before a weekend or a public holiday. 

5.2 At the time you place your order, the shipping fee will be calclulated based on the weight and destination of your order.

5.3 Tracking information will be provided to the Buyer as soon as it is available. It is the sole responsibility of the buyer to ensure that he is present at the time his order is delivered, and that he signs for his order. No claims will be entertained if the buyer was not present at the time of delivery, if an unknown individual or third party signs for the goods, or if goods are left at the Buyer's address without a signature.  Any order that is refused or returned is done so at the expense and risk of the buyer.  

5.4 International shipments may be subject to inspection by local customs or the carrier. We cannot guarantee that 'sealed' items will be delivered 'sealed' as they may be opened for inspection. Items opened for inspection by customs officials will be resealed with official 'customs' tape.

5.5 All shipments must be visually inspected prior to acceptance. If a package appears to be have been opened or damaged in transit, it should not be accepted unless it has been officially opened and resealed by a government or customs agency. Claims of short counts or items missing from packages which arrive damaged or opened will not be entertained. Prior to dispatch, the contents of all packages are verified by at least two members of staff.

5.6 If a shipment is returned or refused by the Buyer, the Buyer assumes all responsibilities and costs, including return shipping fees and any clearance fees. Any loss or theft in transit back to SwissBullion.eu is also the responsibility of the Buyer, and no claims can be accepted.

5.7 Orders may be shipped in several packages / boxes for insurance purposes.

6. Storage

6.1 SwissBullion.eu offers its clients sercure vault storage located in Switzerland. When items are kept in vault storage, clients then have the option to request delivery (location dependent), collect their order in person, or sell their precious metals holding back to SwissBullion.eu - In order for goods to be shipped or collected, the client's account must be up to date, and all storage fees or shipping fees, including outstanding payments for other orders, must be up to date. No deliveries or collections are possible if clients accounts are in arrears. Clients may liquidate positions (or partial positions) in order to cover storage fees. In the event that items are sold back to Swi
ssBullion.eu - funds can only be transferred back to the bank account from which they originated. Under no circumstances may funds be transferred to a third party.

6.2 If a client holds goods in storage and has not logged into their account and has unpaid storage fees for a period of at least three years, and The Company has made attempts to contact the client unsuccessfully: 
 
(i) The Company reserves the right to liquidate the client’s holdings. This is subject to a processing fee of £150 (or currency equivalent).
(ii)  If a client’s position has been liquidated, the client has a further calendar year (365 days) from the date of liquidation to contact The Company in order to arrange transfer of the remaining account balance.
 
6.3 All storage accounts are offered free of charge for the first 180 days. Thereafter accounts are subject to a monthly fee, as per the vault storage fee schedule. It is the responsibility of the client to ensure that account fees are paid promptly. Accounts in arrears are subject to a fee of the greater of £10 (or currency equivalent) or 1% of the outstanding balance per month. Fees will continue to be charged until the outstanding account fees are paid. 
 
6.4 In the event that a client refuses to pay account fees, The Company reserves the right to:
 
(i) Refuse to conduct any further business with the client, including processing any withdrawal, transfer, delivery or new order requests.
(ii) Sell a portion of the client’s holdings in order to cover their outstanding debts.
(iii) Terminate the business relationship with the client. In the event the relationship is terminated, The Company will provide the client with 30 days notice, during which time the client may settle their outstanding debts. At the close of 30 days, any outstanding positions will be liquidated, and the funds transferred back to the client at the current purchase rate offered by The Company.

6.5 All bullion in storage is insured against theft and damage as a result of fire, flooding or explosion only.

6.6 Bullion storage fees are subject to a minimum charge of 25 CHF / 25 Euros / 25 USD / 20 GBP depending on the base currency which the order is placed in. For clients ordering in other currencies, the live exchange rate will be used to calculate the monthly fee. 

7. Cancellation

7.1. We reserve the right to cancel any order at our sole discretion.

7.2 For orders where the price is subject to fluctuations in the financial markets, the right for the buyer to cancel under the "The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013" (the distance selling regulations) does not apply. Clients that wish to cancel such orders will be liable to the greater of a cancellation fee of 2% of the invoiced value of the order or a minimum cancellation fee of 100 Swiss Francs / €95 (or currency equivalent on the day of cancellation) and any loss caused to the company as a result of a difference in the market price of the underlying commodity. 

7.3 If the client cancels or defaults on an order without the express permission of the company it shall render the account delinquent.

8. Liability Of Market Information and availability of the websites:

8.1 The Website operates without any warranty offered to the Buyer. This includes warranties of merchantability, non-infringement and use for particular purpose. In particular, we make no warranty that the content of the website is error-free and timely with all updates.

8.2 SwissBullion.eu and SB Asset Management Ltd are under no circumstances liable for any damages resulting from use of The Company's website, from goods or services provided, or from website content. The Company is also not liable for any damages, including indirect, consequential, punitive or incidental damages including damages for loss of profits, use, data or other intangibles, even if we have been advised of such possibility of damages.
