These Terms and Conditions ("Terms") govern the use of the Swiss Bullion (BVI) Limited website ("SwissBullion.com"), and all transactions made through it. Swiss Bullion (BVI) Limited, registered in the British Virgin Islands under company number 2155170 ("the Company"), operates this website to facilitate the purchase, sale, and storage of precious metals. Whether you’re looking to invest in precious metals or liquidate part of your assets, our services are designed to assist you.

1. Agreement Overview

These Terms outline the contractual relationship between SwissBullion.com ("we," "us," "our") and the users of our services, whether they are sellers or purchasers ("you," "your"), regardless of whether you are an individual, corporation, or other entity. By engaging in any transaction with SwissBullion.com, including via our website or telephone services, you confirm that you have the legal right and capacity to enter into this agreement. You also acknowledge that you have read and accepted these Terms. If you do not agree with these Terms, you must cease using our website and refrain from conducting any transactions with us. The Company reserves the right to amend these Terms at any time without prior notice. Please check this page regularly for updates.

2. Website Use

2.1 The Company reserves the right to modify, suspend, or discontinue the website, any of its features, content, or services, including storage facilities, at any time. Any such changes will be reflected in these Terms, and it is your responsibility to stay informed of any updates.

2.2 You are responsible for acquiring and maintaining any necessary equipment, software, and services needed to access and use the website, including but not limited to, modems, hardware, software, and long-distance or local telephone services.

3. Rules of Use

3.1 To use the website, place orders, and receive products via the website, you must:

(i) Be at least 18 years of age.

(ii) Provide information as required by anti-money laundering (AML) and Know Your Customer (KYC) regulations. Typically, this includes completing an AML form, and providing copies of identification documents and a utility bill for all beneficial owners.

(iii) At the sole discretion of the Company, a detailed source of funds statement may also be requested.

3.2 Information provided during the account registration process must be accurate and complete. You must notify us of any changes to your personal information within 14 business days.

4. Pricing and Payment Terms

4.1 The website operates using a live pricing system provided by FXData.ch. All prices quoted are subject to change based on market fluctuations. When you confirm an order on our website, you are contractually obligated to complete the purchase. Due to market dynamics, the prices and availability of bullion products may change rapidly. The Company sets all buy and sell prices, which may vary accordingly. In case of a pricing error or software malfunction, we reserve the right to offer a re-quote or cancel the order. Offers to sell or liquidate bullion are locked in at the current market rates provided on our website or through an email offer, and are final.

4.2 Goods will not be dispatched until the Company has received full payment of cleared funds via bank transfer. If a client has a negative account balance or owes money on previous orders, canceled orders, accrued storage fees, or other fees, the Company reserves the right to withhold shipping or release goods until the account is settled.

4.3 Full payment must be initiated within two business days, and we must receive it within eight business days. Any delays should be communicated immediately. The Company reserves the right to report and take action against fraudulent activities.

5. Binding Agreement

5.1 Placing a transaction with us, including an order on our website, creates a binding agreement. By agreeing to buy or sell bullion, you commit to completing the delivery or payment. Cancellations are not permitted once an order is confirmed. If you later request a buyback of bullion, the transaction will be governed by our Buyback Terms.

6. Order Placement Terms

6.1 Orders can only be placed directly through the website. The Company does not accept orders via telephone or email.

6.2 The details provided with each order must be accurate and correct.

6.3 All orders will be confirmed by email shortly after being placed.

6.4 The website uses a Pound Sterling currency feed, and all orders are converted into Pounds Sterling on the day the order is placed. The Company does not hedge foreign exchange rates for clients and is not responsible for currency fluctuations. If an order is canceled, the value of the net refund will be calculated using the exchange rate applied at the time of the original transaction.

6.5 Your order is an offer to purchase bullion from us, which is subject to our acceptance.

6.6 All orders are subject to verification, payment, and product or market availability.

6.7 If the products you ordered are not available, you will be notified by the Company via email, using the contact details you provided, and you will have the option to:

(i) Wait until the products are back in stock.

(ii) Request alternative products of equivalent value (at the time of order).

(iii) Receive a full refund of the amount paid.

7. Email Confirmation and Communication

7.1 After placing an order, you will receive an invoice via email. Please ensure that our emails are not blocked by your spam filters.

7.2 Account notifications are not sent routinely. However, you can activate them in your ‘MyVault’ account settings if you wish to receive them.

8. Delivery Terms

8.1 After receiving your payment, we will ship your order within the timeframe specified on our website, subject to product availability. Please ensure that your shipping address is accurate and that you are available to receive the shipment. Delays may occur due to high demand or reduced supply, and we will notify you of any significant delays.

8.2 Delivery will be made to the address you provided when placing your order. The Company does not deliver to P.O. box addresses. Orders are dispatched on business days, Monday through Thursday. Due to shipping insurance policy conditions, shipments are not dispatched on or the day before public holidays or weekends. Goods will not be released until full payment is received.

8.3 The applicable delivery fee will be clearly stated during the checkout process.

8.4 When your goods are shipped, the Company will provide tracking information via email within one business day of dispatch. It is your responsibility to ensure someone is present at the delivery address to sign for the package. Claims arising from packages being signed for by an unknown individual or any other third party at the delivery address are at your risk. Refused or returned shipments are also at your risk. Shipments delivered when you were not available to sign for them are at your own risk.

8.5 International shipments may be subject to inspection by local customs or the carrier. The Company cannot guarantee that items will remain sealed during transit as they may be opened for inspection. Items opened for inspection by customs officials will be resealed with official 'customs' tape.

8.6 You are responsible for any customs fees, duties, taxes, and additional charges that may apply to international shipments, which are not covered by the Company.

8.7 All shipments must be visually inspected before acceptance. If a package appears to have been opened or damaged in transit, it should not be accepted unless it has been officially opened and resealed by a government or customs agency. Claims for missing items or short counts from packages that arrive damaged or opened will not be entertained. The contents of all packages are verified by at least two members of staff before dispatch.

8.8 If a shipment is refused by the recipient or is undeliverable at the designated address, the client is responsible for all return shipping costs and associated customs clearance fees. Return shipping fees are typically no less than €100 (or equivalent in other currencies).

8.9 Orders exceeding €2,000 (or equivalent in other currencies) may be split into multiple packages depending on the destination.

8.10 Products labeled as ‘VAT-Free’ or ‘storage only’ are generally available for storage only and may not be available for delivery.

9. Storage

9.1 The Company offers secure storage for clients wishing to store their bullion. Stored bullion can be shipped or sold back to the Company using the ‘MyVault’ facility. Vault orders will not be released if there are outstanding fees for storage, shipping, or other unpaid orders. Items may be sold back to the Company from storage. Please note that funds can only be transferred to the original bank account used for payment, and the account must be in the client’s name.

9.2 Storage is provided free of charge for the first 185 days. After this period, accounts are subject to a monthly fee as per the vault storage fee schedule. Clients are responsible for ensuring that storage fees are paid promptly. Storage fees after the first 185 days are calculated as follows:

9.3 Accounts in arrears are subject to a fee of the greater of €10 (or equivalent in other currencies) or 1% of the outstanding balance per month. These fees begin to accrue 90 days after an account has a negative balance and will continue to be charged until the outstanding balance is paid.

9.4 If a client refuses to pay account fees, the Company reserves the right to:

(i) Cease all business dealings with the client, including processing withdrawal, transfer, delivery, or new order requests.

(ii) Liquidate a portion of the client’s holdings to cover any outstanding debts.

(iii) Terminate the business relationship with the client. If the relationship is terminated, the Company will provide the client with 30 days' notice to settle any outstanding debts. After 30 days, any remaining positions will be liquidated, and the funds returned to the client at the current purchase rate offered by the Company.

9.5 If a client's storage fees exceed the value of their bullion holdings, the Company reserves the right to liquidate the holdings to cover the outstanding debt.

9.6 All bullion in storage is insured against theft and damage caused by fire, flooding, or explosion.

10. Cancellation Terms

10.1 The Company reserves the right to cancel any order at its discretion.

10.2 For orders where the price is subject to financial market fluctuations, the right to cancel under "The Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013" (distance selling regulations) does not apply. Clients who wish to cancel such orders will be liable for a cancellation fee of 2% of the order’s invoiced value or a minimum cancellation fee of €100 (or equivalent in other currencies) on the day of cancellation.

10.3 If a client cancels or defaults on an order without the Company’s express permission, the account will be considered delinquent.

11. Liability Terms

11.1 We reserve the right to refuse service, correct errors, cancel transactions, require wire transfers, withhold shipments or payments for unpaid orders, and take other security measures as necessary.

11.2 The website and its content are provided "as is" without any warranties, express or implied. The Company disclaims all warranties, including but not limited to those of merchantability, non-infringement, and fitness for a particular purpose. We make no warranty that the content on the website is error-free or up-to-date.

11.3 The Company is not liable for any damages, including those arising from the use or inability to use the website, from goods or services acquired through the website, or from any content posted on the website by us or others. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to damages for loss of profits, use, data, or other intangibles, even if we have been advised of the possibility of such damages.

12. Rights Reserved by SwissBullion.com

12.1 Governing Law: These Terms are governed by the laws of the British Virgin Islands. Any disputes must be filed in writing within one year of arising.

12.2 Limitation of Liability and Indemnity: Our liability is limited to the purchase or sales price agreed upon. We are not liable for indirect, incidental, or consequential damages. You agree to indemnify us against any claims arising from your use of our services.

12.3 Force Majeure: We are not liable for any failure to perform due to causes beyond our control, such as natural disasters, government actions, or market disruptions.

13. Complete Agreement

These Terms, along with our Privacy Policy and any purchase orders, constitute the entire agreement between you and SwissBullion.com.

14. Modification of Terms

We reserve the right to amend these Terms at any time. Continued use of our services after changes are made constitutes your acceptance of the revised Terms.
